Background
Adhikaraṇa, the name used in the Pāli Canon to refer to disputes and legal matters arising within the monastic community, is an important part of the Vinaya Piṭaka. Such matters often arise from misunderstandings, differences of opinion, or violations of training rules among bhikkhus and bhikkhunīs.
In the history of Theravāda Buddha-Dharma, the Buddha and his disciples also faced complex situations concerning discipline and communal administration. To maintain harmony, purity, and unity in the Sangha, the Buddha established clear rules and methods for handling disputes. Adhikaraṇa refers precisely to the principles and procedures for resolving such matters fairly, transparently, and in accordance with the Dharma.

Adhikaraṇa is divided into four main types of dispute: disputes about views (Anusaya-adhikaraṇa), disputes about facts (Attha-adhikaraṇa), disputes about wording (Vyañjana-adhikaraṇa), and disputes about legal prescriptions (Paññatti-adhikaraṇa).
To resolve these matters, the Vinaya Piṭaka lays down four methods: Tamasā (recognizing the truth through evidence), Sāmaññatā (common agreement), Paññatti (following the regulation), and Aniccatā (impermanent change). These methods emphasize the importance of discovering the truth, respecting the shared view of the community, and adhering to established rules.
The regulations in Adhikaraṇa also include details concerning how to convene, discuss, and vote in order to make decisions. Every member of the Sangha has the right to participate and express an opinion, ensuring fairness and a democratic character. Decisions must be approved by the majority in order to take effect, and they need to be recorded as evidence.
